Allahabad High Court Takes A Forward Step In Ruling Against Triple Talaq

“No Personal Law Board is above the Constitution,” said the Allahabad High Court in its latest ruling against the ‘triple talaq’ concept of Muslim law. In its ruling, the HC stated that the Triple Talaq was not just unconstitutional, but also unfair and unjust to Muslim women’s rights. The order that was passed by Justice Suneet Kumar was a result of a petition that had been filed by a woman whose husband had arbitrarily divorced her, according to TNN. He went on to say, “Personal Law cannot be above the Constitutional law.”

While a majority of the nation is rejoicing at the passing of this rule, The All India Muslim Personal Law Board (AIMPLB) isn’t happy with the ruling and plan to appeal against the judgment.

“About the practice being unconstitutional, I just have to say that the practice is a part of Islamic law. The personal law is an integral part of Islam and the two cannot be seen in isolation,” said Maulana Khalid Rasheed Firangi Mahali, a member of the AIMPLB.
